Statistics show over 1,000 people die in the USA from bicycle accidents every year, while another 500,000 bicyclists are injured. The city of Richmond has invested millions of dollars in promoting our community as a bicycle-friendly community, as our government hosted the 2015 UCI Road World Championships. Many new bike lanes were constructed on Franklin St and other streets to help with safety, but this has caused confusion for many motorists. Epperly & Follis have seen this first hand. The bike lanes constructed on Franklin Street run right in front of our office at 7 East Franklin Street. The first couple of weeks it was confusing to the bicyclist. They continued to use both sides of the street but now most bicyclists are using the marked bike lanes
In 2019, the Virginia Department of Motor Vehicles reported 615 injury accidents and 13 fatalities for people on bicycles. It is clear from these statistics that safety is still a major concern.
Cyclists are expected to follow the same rules of the road as cars and other vehicles on the roadways. Many people don’t understand this and will ride their bike on the sidewalk or on the wrong side of the street. Bicycles are not supposed to ride on the side-walks. Sidewalks are for pedestrians. Stop signs and other traffic regulations are not just for cars. Bicycles are required to follow these laws too.
When it comes to crosswalks, people on bicycles are expected to yield to oncoming traffic when there are no traffic signals or stop signs. They must follow stop signs and traffic signals just like automobiles.
These laws are meant to protect the rights of all motorists and cyclists. While many laws have been passed to protect everyone, there are still going to be accidents.
If you were involved in a bicycle accident, you may be eligible to receive compensation for your injuries when another driver is found negligent. Unlike many states, you can only recover damages from another party if they are 100% negligent for the accident.
Unfortunately, serious injuries are common in accidents involving bicycles. Traumatic brain injuries can cause a lifetime of issues. Spinal cord injuries or other back injuries can often result too. Multiple broken bones and fractures are often seen at the accident scene.
An experienced bicycle accident attorney can provide proper guidance after an accident, but you want to get medical attention right after an accident. Head injuries could take days to manifest, so it is important to get checked out by physicians as soon as possible. Do not refuse the ride in the ambulance even if you don’t think you need to go. The documentation of your injuries is very important to your case and will be needed when your attorney and insurance adjuster investigate the facts of your case.
It is possible you may still be well enough to collect information at the scene of the incident. Taking photos of the scene is important. Take photos of the car, your bike, skid marks on the road, and anything else you feel would be important for your documentation.
Collect all information from the other parties who are involved. Find out what car insurance company insures the automobile. Take note of the make model, and color of the car, and get the license plate information too. Get the contact information for any witnesses.
The police report should include much of this information, but you want to try to get this information for yourself too.
There are some nuances involved when it comes to bicycles where you should strongly consider hiring a professional bicycle attorney to represent you for your damages. An experienced attorney will do a thorough investigation to determine what you will be able to recover in the accident.
Some of the losses you should be able to recover include lost wages for the income you lost from being out of work. If you are permanently disabled, you could recover the income you would have received if you had not been injured.
All medical expenses are recoverable. This includes doctor visits, hospitalization, the trip to the ER, surgeries, and any other expenses included in your accident. General pain and suffering would be recoverable. If the cyclist is injured, the surviving family members could receive compensation.
Most importantly the laws are created to help protect bicyclists. When riding a bicycle, be careful, follow the laws and wear a helmet.
The sad truth is most accidents involving bicycles result in serious injuries in many cases. The bicycle attorneys at Epperly & Follis, P.C. have decades of experience in working with personal injury cases. Their attorneys will make sure no one takes advantage of you in your time of need.

“I was represented by Craig Follis, partner at Epperly & Follis, and was very pleased with Craig’s dedication, hard work, and ultimately the outcome of my case.
Throughout the process, his consulting services were top notch; there was never a time I lacked confidence in his ability to arrive at the outcome I wanted or felt that I could have selected better legal counsel.
Will honestly say, I was very impressed with his skill, and further, how well my case was prioritized. From end-to-end, he kept constant contact and provided his expertise in terms I could easily understand.
Definitely feel as though I had all the right information and mostly understand the process, should this happen again. I highly recommend Craig Follis for legal counsel, especially relating to injury-related accidents.”
